Gauhati HC grants anticipatory bail to three in journalist assault case

Three prime accused in the alleged beating up of a journalist, the photos and videos of which went viral on social media, have been granted anticipatory bail by the Gauhati High Court.

The court of Justice Ajit Borthakur hearing an anticipatory bail plea ( 3299/2020) has granted the three accused — Abani Thakuria, Sanjay Thakuria and Biswajit Das — interim pre-arrest bail on furnishing Rs 15,000 each as a bail bond.

The three were allegedly identified from the videos and photographs in which, a journalist, beaten blue, was seen tied to a pole.

Milan Mahanta, a correspondent for vernacular daily ‘Pratidin’ in Mirza, about 40 km from state capital Guwahati, was, according to his editors, investigating a gambling racket active in the area.

Incurring injuries to his neck, head, and ears, Mahanta had filed a complaint (515/20) against five persons visible in the video whom he suspected were “gamblers” at Palashbai Police station.

The three granted anticipatory bail along with two others have been charged with section 341 (wrongful restraint), 324 (voluntarily causing hurt), 325 (causing grievous hurt), 392 (robbery), and 34 (crime committed with common intention) of Indian Penal Code.

“Considering the facts and circumstances of the case, it is provided that in the event of arrest, each of the petitioners named above shall be released on interim pre-arrest bail… on furnishing bail bond of Rs 15,000,” the judgement passed last Wednesday, said.

While Abani and Biswajit, who are healthy, have been asked by the court to appear to the investigation officer of the case while Sanjay, who had stated himself ill to the court, will have to appear after being released from the hospital.

One man has so far been arrested in this regard.
